1. Acceptance of Terms

By accessing or using Noctaras ("Service", "we", "us", or "our") at noctaras.com, you ("User", "you") agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

Noctaras is an AI-powered dream interpretation and personal journaling platform. The Service allows users to:

• Submit dream descriptions and receive AI-generated interpretations
• Maintain a personal dream journal
• Access premium features through a paid subscription

3. Eligibility

You must be at least 13 years of age (or 16 in the European Union) to use Noctaras. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

4. User Accounts

Some features of the Service may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. Subscriptions & Payments

Free Plan: Noctaras offers a limited free tier with up to 3 dream interpretations per month at no cost.

Pro Plan: Premium subscriptions are available on a monthly or annual basis. Subscription fees are billed in advance and are non-refundable except as described below.

• Payments are processed by LemonSqueezy. By subscribing, you agree to their terms of service
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Prices may change with 30 days' notice

Refund Policy: We offer a 7-day refund on your first subscription payment if you are not satisfied with the Service. To request a refund, contact support@noctaras.com within 7 days of your first charge.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Submit content that is harmful, threatening, abusive, or harassing
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Reverse engineer or attempt to extract the source code of the Service
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with others

7. Your Content

You retain ownership of all dream entries and content you submit to Noctaras. By submitting content, you grant us a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service to you.

You represent that your content does not violate any third-party rights or applicable laws. We reserve the right to remove any content that violates these Terms.

You acknowledge that dream content submitted for interpretation is sent to our AI provider (OpenAI) for processing. Do not submit sensitive personal information about yourself or others that you would not want processed by a third-party AI system.

8. Intellectual Property

The Service and its original content, features, and functionality (excluding user-submitted content) are owned by Noctaras and are protected by intellectual property laws. Our name, logo, and branding may not be used without prior written permission.

AI-generated dream interpretations are provided for your personal use. You may not reproduce, distribute, or commercially exploit these interpretations without our permission.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Dream interpretations will be accurate, complete, or suitable for any purpose
• Any errors or defects will be corrected

10. Limitation of Liability

To the maximum extent permitted by applicable law, Noctaras shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other business reason.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising from these Terms will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to binding arbitration.
