1. Acceptance of Terms

By accessing or using Noctaras ("Service", "we", "us", or "our") at noctaras.com or on iOS and Android, you ("User", "you") agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

Noctaras is a sleep app. The Service offers:

• Guided meditations, sleep sounds, sleep stories, and breathing exercises
• A personalized nightly audio session and multi-night programs
• A private journal and nightly check-in
• Optional premium features through a paid subscription

3. Eligibility

You must be at least 13 years of age (or 16 in the European Union) to use Noctaras. By using the Service, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.

4. User Accounts

Some features may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use of your account

We may suspend or terminate accounts that violate these Terms.

5. Subscriptions & Payments

Free features: Noctaras offers a free tier you can use at no cost.

Premium: Optional premium subscriptions are available on a monthly or annual basis and unlock the full library.

• Purchases and subscriptions are processed by the Apple App Store or Google Play, under their terms
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You manage or cancel your subscription in your App Store or Google Play account settings
• The price is shown to you before you confirm a purchase and may change with notice
• Refunds are handled by the App Store or Google Play according to their policies

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools to scrape, crawl, or extract data or audio from the Service
• Copy, redistribute, or publicly perform our audio or other content outside the app
• Reverse engineer or attempt to extract the source code of the Service
• Impersonate any person or entity
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with others

7. Your Content

You retain ownership of the journal notes and other content you create in Noctaras. Your journal notes and check-ins are stored on your device by default. If you enable account sync, you grant us a limited, non-exclusive license to store and sync that content solely to provide the Service to you.

Noctaras does not send your journal notes or check-ins to any third-party AI service. We reserve the right to remove content that violates these Terms.

8. Intellectual Property

The Service and its content (including audio, meditations, sleep stories, text, design, name, logo, and branding), excluding content you create, are owned by Noctaras or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or commercially exploit them without our written permission.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. In particular, the Service is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• The Service will improve your sleep or produce any particular result
• Any errors or defects will be corrected

10. Limitation of Liability

To the maximum extent permitted by applicable law, Noctaras shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other business reason. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration.
